Privacy Policy

This Privacy Policy (“Policy”) describes how 8295042 Canada Inc. (“8295042 Canada Inc.,” “Company,” “we,” “us,” or “our”) collects, uses, stores, and protects information provided by customers and users (“Customer,” “you,” or “your”) in connection with access to and use of our software-as-a-service (SaaS) platform (the “Services”). By using the Services, you consent to the practices described in this Policy.

1. Information We Collect

In connection with the Services, Customers may upload or transmit certain data, which may include but is not limited to:

• Product and item information
• Distributor and supplier pricing
• Menu data and recipes
• Sales, revenue, and transaction information
• Any other business-related operational data (collectively, “Customer Data”)

Customer Data remains the sole property of the Customer.

2. Limited Use of Customer Data

Except as expressly permitted herein, 8295042 Canada Inc. shall not access, use, process, or disclose Customer Data for any purpose other than to provide technical support and resolve support tickets relating to the Services.

Specifically:

• Customer Data will not be used for analytics, profiling, product development, marketing, resale, or benchmarking.
• Access to Customer Data by Company personnel is strictly limited to those with a legitimate business need, solely for troubleshooting or providing technical assistance at the Customer’s request.

3. Data Security and Hosting

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect the integrity and confidentiality of Customer Data. Measures include but are not limited to:

• Encrypted data transmission via Secure Socket Layer (SSL) technology.
• Hosting and storage of Customer Data on Microsoft Azure servers located in the Midwestern United States, leveraging Microsoft’s industry-standard security protocols, redundancy, and compliance certifications.
• Role-based access controls and audit logging to ensure only authorized personnel can access Customer Data.

While we employ industry-standard practices, no method of transmission or storage over the Internet is 100% secure, and therefore we cannot guarantee absolute security.

4. Sharing and Disclosure

8295042 Canada Inc. does not sell, rent, or otherwise make Customer Data available to third parties. Customer Data may only be disclosed:

1. As required by applicable law, regulation, legal process, or governmental request.
2. To enforce our Terms of Service or protect the rights, property, or safety of the Company, its customers, or others.
3. With Customer’s prior written consent.

5. Data Retention and Deletion

Customer Data is retained only for as long as necessary to fulfill the purposes described in this Policy or as required by law. Customers may request deletion of their Customer Data at any time by contacting us at the details below. Upon such request, and subject to legal or contractual requirements, we will permanently delete or anonymize Customer Data within a commercially reasonable period.

6. Ownership of Data

As between the parties, all Customer Data remains the exclusive property of the Customer. 8295042 Canada Inc. makes no claim of ownership over Customer Data.

7. International Transfers

Where applicable, Customer Data may be transferred and processed outside the jurisdiction in which it was originally collected. By using the Services, you consent to such transfers, provided they are subject to safeguards consistent with this Policy.

8. Changes to This Policy

We reserve the right to modify or update this Policy at our discretion. Material changes will be communicated via the Services or by direct notice to Customers. The “Effective Date” at the top of this Policy will be updated accordingly. Continued use of the Services after such changes constitutes acceptance of the updated Policy.
